SMS Terms & Conditions
The following SMS Terms & Conditions (“SMS Terms”) explain how ClearSight LASIK & Lens (“ClearSight,” “we,” “us,” or “our”) uses text messaging programs in connection with our services. These SMS Terms supplement and are incorporated into our main Privacy Policy and any other written agreements you have with us. By enrolling in, or otherwise consenting to, any ClearSight SMS program, you agree to these SMS Terms.
1. Consent to Receive Text Messages
By providing your mobile phone number to ClearSight and affirmatively opting in (for example, by checking a box, signing a form, or texting a keyword to one of our numbers), you consent to receive text messages (SMS and MMS) from ClearSight at the mobile number you provide.
Depending on how you opt in, messages may include:
- Care-related messages such as appointment reminders, scheduling updates, pre- and post-visit instructions, and other treatment-related communications;
- Account and service messages such as registration confirmations, billing or insurance notices, and operational updates; and
- Job applicants may be notified about their application stage, including invites or reminders to interviews; and
- Marketing messages, including information about services, events, promotions, and patient education resources. Your consent to receive marketing text messages is not a condition of any purchase, medical evaluation, or treatment.
2. Message Frequency
Message frequency will vary based on your relationship with ClearSight, the specific SMS program(s) you enroll in, and your appointment schedule. We may provide a frequency estimate at the point of opt-in (for example, “Message frequency may vary.”).
3. Message & Data Rates
ClearSight does not charge for SMS messages; however, standard message and data rates may apply from your wireless carrier. If you have questions about your text or data plan, please contact your carrier.
4. Opting Out of Text Messages
You may opt out at any time:
- Reply STOP to any ClearSight text message to stop receiving messages from that specific program/number.
- We will send a one-time confirmation text to acknowledge the opt-out.
You may also opt out by contacting us using the information in the Contact Us section. Opting out of marketing messages will not affect your ability to receive necessary care reminders or communications through other permitted channels.

6. Privacy, Security & Protected Health Information (PHI)
No mobile opt-in or text message consent will be shared with third parties or affiliates.
We limit the amount of protected health information (PHI) included in text messages and generally restrict content to the minimum necessary (for example, your name, appointment date/time, and basic instructions). We do not use unencrypted SMS to discuss detailed diagnoses, sensitive clinical information, or complex medical instructions unless you expressly request or authorize such communications and applicable law permits it.
Unencrypted text messages may be viewable by others who have access to your device, notification previews, or cellular account. By participating in a ClearSight SMS program, you acknowledge these risks. If you prefer not to receive any PHI by text, you may opt out at any time and request alternative communication methods.
7. Eligibility & Responsibility for the Mobile Number
By opting in, you represent that you are the owner or authorized user of the mobile number provided and that you are at least 18 years old (or the legal guardian of a minor patient). If your number changes, you agree to notify us promptly so that we can update our records and help protect your privacy.
8. Third-Party Providers & 10DLC/Carrier Rules
We may send and receive messages using third-party messaging providers and telecommunications carriers. These services process messages on our behalf consistent with our privacy and security requirements. Our programs are designed to comply with applicable laws and industry standards (including TCPA and CTIA/10DLC guidelines). However, delivery is not guaranteed and may be affected by carriers or other third parties outside our control.
9. Carrier Disclaimer
Wireless carriers are not liable for delayed or undelivered messages.
